By accessing or using www.AQR.com (the “Service”) operated by AQR (“we”, “our”, or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service. We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. The AQR name, logo, and other marks used on the Service are our trademarks. Nothing in these Terms grants you any right to use our trademarks without our prior written permission.
4. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AQR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: • The Service will be uninterrupted, error-free, or secure • Any errors will be corrected • The Service or the server that makes it available are free of viruses or other harmful components Note: Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to EU consumers.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AQR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) $100 CAD.
6. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration or in the courts of Ontario, Canada, and you consent to the personal jurisdiction of such courts. EU residents: You may also bring a claim before your local consumer protection authority or court. Nothing in these Terms affects your rights as an EU consumer.
7. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination: • Your right to use the Service ceases immediately • We may delete your account and associated data, subject to our Privacy Policy • Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability You may terminate your account at any time by contacting us at privacy@aqr.com.
8. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.
